What is Talaaq?

Talaaq is the Islamic process of divorce. ShiaJamaat facilitates the formal Talaaq petition for couples who meet the required conditions, providing a structured, Sharia-compliant process guided by our resident Alim. Upon completion, a Talaaq Certificate is issued — which is required for future Nikaah ceremonies should either party wish to remarry.

The Talaaq process at ShiaJamaat is handled by our resident Alim, Sh. Mohamed Rashid of Birmingham.

Pre-condition must be met before you can apply for Talaaq: You must have completed a Pre-Talaaq Mediation process and mediation must have been unsuccessful. If these conditions are not yet met, please see our Mediation service first.

Types of Talaaq

Revocable divorce (Talaaq-e-Raj'ee)

The regular Talaaq granted by the husband. It is revocable — the husband retains the right to take back his wife during the Iddah (waiting period) without requiring a new Nikaah.

Irrevocable divorce

The husband is not entitled to take back his wife without a new Nikaah. This applies in five situations:

  • The divorce of a woman who has reached menopause.
  • The divorce of a woman with whom the husband has not had conjugal relations after their marriage.
  • The third divorce of a woman who has been divorced three times.
  • Divorce by way of Khul'a or Mubarat.
  • Divorce by intervention of a Mujtahid, where a husband is neither willing to maintain his wife nor to divorce her.

Khul'a divorce

Where a wife has developed an aversion to her husband and surrenders her Mahr or some of her property in exchange for the divorce. The property surrendered may exceed the Mahr.

Mubarat divorce

Where both husband and wife have developed mutual aversion. The wife gives some property in exchange for the divorce. The property surrendered must not exceed the Mahr.


What you will need

  • Date of birth for both parties.
  • Contact details for both parties.
  • A written statement of your case — the reasons for filing for Talaaq.
  • Photo ID for both parties.
  • UK Decree Absolute or legal divorce certificate.
  • Evidence that Pre-Talaaq Mediation has been completed and was unsuccessful.
  • A credit or debit card to pay the registration fee on approval.

Requirements

A civil divorce (Decree Absolute) is a legal dissolution of your marriage in the eyes of UK law, obtained through the courts. A Talaaq is the Islamic dissolution of your marriage according to Sharia. Both are separate and both are necessary. The Talaaq Certificate is required for any future Nikaah ceremony.

Islam strongly encourages reconciliation before divorce. ShiaJamaat requires all couples to have undergone a mediation process before a Talaaq petition is accepted. This is both a religious requirement and a procedural safeguard to ensure every opportunity for reconciliation has been genuinely explored. A certificate confirming that mediation was attempted and unsuccessful is needed.

Yes. Talaaq is a formal process that involves both parties. Contact details for the Respondent are required at the time of application. Our team will contact the Respondent as part of the process.

The Process

The duration varies depending on the complexity of the case and the responsiveness of both parties. Please allow several weeks from the date of application. Prompt responses to all correspondence from our team will help the process proceed as quickly as possible.

The £275 registration fee is payable on approval — meaning it is only charged once your application has been reviewed and accepted for processing. If your application is not accepted because the pre-conditions are not met, no fee is charged at that stage.

The Talaaq Certificate is a religious document and is not a legally binding civil document. It is accepted by Islamic organisations and community bodies as evidence of Islamic divorce. Your civil divorce (Decree Absolute) is the legally recognised document and must be obtained separately through the UK courts.

Once a Talaaq Certificate is issued and the Iddah (waiting period) has elapsed in accordance with Islamic law, both parties are free to remarry. You will need to present the Talaaq Certificate when applying for a future Nikaah through ShiaJamaat or any other Islamic authority.
